Affirmative claims are claims filed by the United States Army against the persons who injure service members, dependants, and retirees. Affirmative claims are filed in order to recover lost federal wages and the cost of medical care provided. Affirmative claims are not filed against the injured person.
If you are contacted by the White Sands Staff Judge Advocate Office regarding information about an accident in which you were injured, you are required to provide timely and accurate information concerning your injuries and the events surrounding your injuries. Information you provide is used to recover, through settlement or lawsuit, the cost of medical treatment the government provides to you and any lost federal wages.
If you hire an attorney, the White Sands Staff Judge Advocate Office is able to assist your lawyer by entering into a "representation agreement" with him or her. This agreement allows your attorney to represent the government´s interest in your case, and we assist your lawyer by providing him or her with all the medical records, billing, and other military specific information of which we have access.
